What Is Relative Adoption and Who Can Adopt?

Relative adoption is the legal process in which a child is adopted by a member of their extended family. This allows the child to remain connected to their heritage and provides stability within familiar relationships.

Family members who may be eligible to adopt include:

  • Adult siblings

  • Grandparents

  • Cousins
     

Eligibility requirements vary by country, so it’s important to consult with a qualified adoption professional in the child’s country of residence.

To pursue an international relative adoption, you must be a U.S. citizen.

Consent, Home Study, and Timeline for Relative Adoption

In most cases, both biological parents must consent to the adoption unless their parental rights have been legally terminated. Exceptions include situations where:

  • One parent is deceased or absent (only one signature may be possible)

  • Both parents are deceased (the child’s legal guardian provides consent)
     

A home study is required to apply through CARA (Central Adoption Resource Authority, for India cases) and USCIS (U.S. Citizenship and Immigration Services).

Because approvals must be obtained from authorities in both the child’s country of residence and the U.S., the relative adoption process typically takes 18 to 24 months to complete.

How Relative Adoption Differs from Other Types of Adoption

Unlike traditional adoptions, you do not need to wait for a child to be matched to you,  you’ve already identified the child. However, the child must still be determined eligible for international adoption.

For U.S. immigration approval, you must demonstrate that:

​

  • The child cannot be cared for by their birth parents

  • Poverty, incapacity, or other compelling reasons prevent the child’s care

What If You Already Adopted the Child in Their Home Country

This situation depends on whether the adoption is formally recognized by the child’s country’s Central Authority:

  • If recognized, you may need to “un-do” the local adoption to ensure U.S. adoption and immigration steps proceed correctly

  • If not formally recognized, you may be able to restart the process using the required international adoption pathway

In some cases, orphanage support fees may be waived.
